On June 17, 2011 in the hotel LifeDesign in Belgrade, held a seminar on the topic “Mediation as a method of alternative dispute resolution in construction”. This event was implemented as an extension of ACES successful cooperation with IFC (International Finance Corporation – World Bank Group).
Speakers at the seminar were Srđan Topalović and Blažo Begović The seminar included the following important topics:
• The legal framework for mediation – EU Directives and national law on mediation, modes of alternative dispute resolution (ADR) mechanisms for the prevention of disputes, Mediation and FIDIC conditions of contract;
• Mediation – The basic principles, participants, methods of keeping the mediation structure of the mediation process (preparation, opening, negotiation and conclusion of trial proceedings), the Treaty of Accession of mediation, position and interests embossing, Proposal Agreement / other possible outcomes;
• Communication skills as a prerequisite for a successful mediation – The characteristics of positive and negative communication, delay in communication, elements of effective communication, active listening (empathy, reflection, summarizing), conflict-development phase of the conflict (and their approaches to conflicts below, identification of positions, identification of interest, redefining the problem), Styles of behavior in conflict, Conflict mediation.
